1. General Risk of Trading and Investing

Trading financial instruments involves substantial risk. The value of investments can go down as well as up, and you may receive back less than your original investment. You should carefully consider whether trading or investing is appropriate for you in light of your financial circumstances, experience, knowledge, and investment objectives.

There is no guarantee of profit. Historical returns, simulated performance, and backtested results are hypothetical and are not indicative of future performance. Markets can be volatile, illiquid, and unpredictable. External factors such as economic events, political instability, regulatory changes, and natural disasters can have significant and sudden impacts on the value of financial instruments.

2. Specific Risks

2.1 Market Risk

The value of any financial instrument is subject to fluctuations in market conditions. Prices can change rapidly and adversely due to macroeconomic factors, geopolitical events, industry trends, company-specific developments, and market sentiment. You may experience significant losses during periods of heightened volatility.

2.2 Leverage Risk

If you trade leveraged products (such as CFDs or margin accounts) through a Third-Party Broker, your losses can exceed your initial deposit. Leverage amplifies both gains and losses. A relatively small market movement can have a proportionately larger impact on your capital. You may be required to deposit additional funds at short notice to maintain your position, and failure to do so may result in the automatic liquidation of your position at a loss.

2.3 Liquidity Risk

Certain financial instruments may be difficult to sell or exit at a fair price, particularly during times of market stress. Low liquidity may result in wider spreads, delayed execution, or the inability to close a position entirely.

2.4 Technology and System Risk

The Platform relies on technology, including servers, software, internet connectivity, and third-party APIs. You acknowledge that:

  • System outages, delays, errors, interruptions, or failures may occur and could prevent you from accessing the Platform or receiving timely information.
  • Data feeds, price quotes, and market data displayed on the Platform may be delayed, inaccurate, or incomplete.
  • Algorithmic outputs and Signals may contain errors arising from software bugs, data quality issues, or unforeseen market conditions.
  • Goldilox is not responsible for any losses arising from technology failures, whether caused by us, third-party service providers, your internet service provider, or your own equipment.

2.5 Algorithmic and Model Risk

The Platform uses automated technical analysis algorithms to generate Signals and scores. These models are based on historical data, mathematical assumptions, and predefined parameters. You should be aware that:

  • No algorithm can predict future market movements with certainty.
  • Models may perform well during certain market conditions and poorly during others (e.g., trending vs. ranging markets, low vs. high volatility).
  • Backtested and simulated results are inherently limited — they are created with the benefit of hindsight, do not account for real-world execution factors (slippage, spreads, fees, latency), and assume conditions that may not be replicable in live trading.
  • Past algorithmic performance is absolutely not a reliable indicator of future results.
  • Overfitting to historical data is a known risk in quantitative analysis and can lead to models that fail in live market conditions.

2.6 Third-Party Broker Risk

If you execute trades through a Third-Party Broker, you are subject to the terms, conditions, risks, and fee structures of that broker. Risks include but are not limited to: broker insolvency, execution quality, order routing practices, regulatory actions, platform downtime, and changes in terms. Goldilox has no control over and accepts no liability for the actions or omissions of any Third-Party Broker.

2.7 Regulatory and Legal Risk

Financial markets are subject to regulation that can change without notice. Regulatory changes may affect the availability, legality, taxation, or terms of certain financial instruments or trading activities in your jurisdiction. It is your sole responsibility to understand and comply with all applicable laws and regulations.

2.8 Currency Risk

If you trade instruments denominated in a currency other than your base currency, exchange rate fluctuations may increase or decrease the value of your positions and any associated profits or losses.

2.9 Cryptocurrency-Specific Risks

Cryptocurrencies and digital assets are highly volatile, largely unregulated, and may be subject to market manipulation, hacking, loss of private keys, protocol failures, and sudden regulatory prohibition. The value of a cryptocurrency can drop to zero. Goldilox does not endorse, recommend, or guarantee any particular cryptocurrency.

2.10 Concentration Risk

Concentrating your investments in a single asset, sector, or market increases the potential for significant losses. Diversification does not guarantee profits or protect against losses, but it is a widely recognised principle of risk management.

3. Hypothetical and Simulated Performance

Where the Platform displays backtested results, historical simulations, model performance metrics, or win rates, you acknowledge and agree that:

  • Such data represents hypothetical results only and does not represent actual trading.
  • Hypothetical results have inherent limitations, including hindsight bias and the absence of financial risk.
  • No representation is made that any account will or is likely to achieve profits or losses similar to those shown.
  • Actual trading results may differ materially from simulated results due to slippage, transaction costs, market impact, latency, and other factors not accounted for in backtesting.

4. No Personal Recommendation

The Content, Signals, and analysis provided by the Platform are generated algorithmically and are not tailored to any individual's personal circumstances. They do not take into account your financial situation, experience level, investment objectives, risk tolerance, tax position, or any other personal factor. You should consult a qualified, independent financial adviser before making any investment decision.

5. Your Responsibilities

By using the Platform, you confirm that:

  • You understand the risks disclosed in this document and accept them fully.
  • You are solely responsible for your own investment and trading decisions.
  • You will not rely on the Platform as a substitute for independent research, professional financial advice, or your own judgement.
  • You have the financial capacity to bear losses arising from trading and investing.

Goldilox expressly disclaims all liability for any trading or investment losses you may incur, whether or not such losses are related to your use of the Platform, reliance on any Content or Signal, or any action or inaction by a Third-Party Broker. This disclaimer applies to the fullest extent permitted by the laws of England and Wales and the Italian Republic.
